A 6% buyer’s fee will be added to the final bids on this auction.


Successful bidder(s) will be required to enter into a purchase agreement within 48 hours of the close of the auction. 10% earnest money is due with the offer. The closing will take place within 45 days of the accepted offer or when the paperwork has been completed to transfer clear title. 


There will be a manual close on this auction. If multiple lots bring more than individual lots, the individual lots will be marked NO SALE and vice versa.


Buyer financing will be allowed with no contingencies. No appraisal contingency. A pre-approval letter must be submitted with the accepted offer. Cash buyers to supply proof of funds with accepted offer. The buyers will put 10% of the total winning bid for earnest money with offers. All offers are subject to approval from the seller.


Auction End Times: The auction will begin closing at the time listed. This auction has what is called an auto extend feature, meaning the auction will not close until all bidding parties are satisfied. If there
are any bids placed in the final 10 minutes of the item closing, the auction ending will be automatically extended 5 minutes from the time the bid was placed. Example: If an auction scheduled to close at 6:00 receives a bid at 5:59, the closing time will automatically extend to 6:04. The auto-extend feature remains active until no further bids are received within a 5-minute time frame.


Auction company employees and/or the auction company may bid on auction items.


Acceptance of Bid Prices: Successful bidder(s) will be required to enter into a purchase agreement within 48 hours of the close of the auction. O’Connor Auction Group will email documents to be executed. They must be emailed back to O’Connor Auction Group within 72 hours of the end of the auction. Unless the auction is noted as "SELLING ABSOLUTE", the seller has the right to accept, counter or reject the final bid. Bidders will also sign an agency disclosure. Successful bidders not executing and returning contracts with down payment deposit within 72 hours will be considered in
default.

Evidence of Title: Seller shall provide an owner’s title insurance policy in the amount of the purchase price purchased.


Deed: Seller shall provide a warranty deed or personal representative’s deed free and clear of all liens and encumbrances.


Possession: Buyer(s) to take possession upon closing.


Real Estate Taxes: All taxes will be prorated to the day of closing using the previous year’s tax amount.


Easements: Subject to all easements of record. There will be a shared driveway easement for ingress and egress.


Zoning: This property is subject to all state and local zoning ordinances. See attached zoning information.


Acreage: Parcel dimensions and acreages are based on legal descriptions.


Bidder Verification: The identity of all bidders will be verified. Bidding rights are provisional, and if complete verification is not possible, O’Connor Auction Group will reject the registration, and bidding activity will be terminated. The seller and selling agents reserve the right to prevent any person from bidding, if there is any question as to the person’s credentials, fitness, etc. Bidders agree to keep their username and password confidential as they are responsible for ALL activity involving their account. When using the website, you must obey all local state and federal laws. Violations will result in termination of website use privileges.

Buyer’s Agency: All buyers are responsible to notify auctioneers of any potential buyer’s agency contracts in place before registration and bidding on the auction and no later than 24 hours prior to auction close.
