The customer's name on the invoice must be the person picking up and paying.  NO EXCEPTIONS! If a firearm is bid on by an individual who has already been denied through a background check previously, the individual will be fully responsible for the payment of the firearm without receiving the purchase. Failure to comply will result in termination on O'Connor Auction Group bidding platform.

Firearms Auction Terms & Conditions
Effective Date: October 1, 2026

 

These Firearms Auction Terms & Conditions ("Terms") apply to all firearms offered for sale through O'Connor Auction Group ("O'Connor Auction Group," "we," "us," or "our"). By registering to bid or placing a bid on a firearm, the bidder ("Buyer") acknowledges and agrees to these Terms, the applicable auction terms and conditions, and all applicable federal, state, and local laws.


O'Connor Auction Group is a federally licensed firearms dealer (FFL). All firearm transfers are subject to applicable law and the requirements of our Federal Firearms License.

 

1. Buyer Eligibility


A winning bid does not by itself establish that the Buyer is legally eligible to receive or possess the firearm.


The Buyer must be legally eligible to purchase, receive, possess, and use the firearm under all applicable federal, state, and local laws.

 

Long gun buyers must be at least 18 years old. Handgun buyers must be at least 21 years old.


O'Connor Auction Group will not transfer a firearm to a person whom we know or have reasonable cause to believe is prohibited from receiving or possessing firearms.


The Buyer is responsible for determining whether the firearm may lawfully be purchased, received, possessed, and used in the Buyer's jurisdiction.


2. Required Firearm Transfer Procedures


Unless an applicable legal exception applies, a firearm transferred by O'Connor Auction Group to an unlicensed purchaser will require completion of ATF Form 4473 and the applicable background-check procedure.


The Buyer must provide valid government-issued identification and complete all required transfer documentation.


O'Connor Auction Group will transfer a firearm only after all legally required transfer procedures have been completed.


A firearm will be released only to the individual who is legally receiving the firearm and completing the required transfer documentation. A Buyer may not designate another person to receive the firearm on the Buyer's behalf unless specifically permitted by applicable law.

 

3. Background Checks


Where required by federal or state law, O'Connor Auction Group will initiate the required background check before transferring the firearm.

 

A $20.00 transfer fee (plus sales tax) per invoice will be added for a background check. 


A firearm will not be transferred when the applicable background-check process results in a denial or otherwise establishes that the transfer is prohibited.


A delayed background check will be handled according to applicable federal and state law and O'Connor Auction Group's transfer procedures.


Certain purchasers or transactions may qualify for an exception to a NICS check under applicable law. O'Connor Auction Group will determine whether an exception applies.

 

Every lower or receiver will require the completion of an ATF Form 4473 and a background check. Neither is required for barrels or uppers. 


4. Wisconsin Purchasers


Wisconsin residents receiving a firearm directly from O'Connor Auction Group must complete all required federal and Wisconsin transfer procedures before the firearm is released.


Wisconsin purchasers should be prepared to present acceptable government-issued identification and complete all required ATF and dealer documentation.


5. No Out-of-State Purchasers


6. Failed, Denied, or Delayed Transfers


If a Buyer cannot lawfully receive a firearm, O'Connor Auction Group will not release the firearm.


If a required transfer is denied, cannot legally be completed, or otherwise fails, O'Connor Auction Group will handle the firearm and the transaction in accordance with applicable law and the auction's stated refund, cancellation, resale, and administrative-fee policies.


A Buyer should not place a bid if the Buyer is uncertain whether the Buyer can legally receive the firearm.


7. Firearm Frames, Receivers, and Other Regulated Items


Certain firearm components, including frames and receivers, may be treated as firearms under federal law.


Such items will be transferred according to their legal classification at the time of transfer.


Buyers should not assume that an item described as a "frame," "receiver," kit, or component is exempt from firearm-transfer requirements.


8. Antique and Curio & Relic Firearms


Some antique firearms and firearms qualifying as curios or relics may be subject to different federal rules.


Buyers are responsible for determining whether a particular firearm qualifies for any applicable exception.


O'Connor Auction Group reserves the right to require an FFL transfer whenever necessary to comply with applicable law or our compliance procedures.


9. Firearm Condition and Inspection


All firearms are sold "AS IS, WHERE IS," unless otherwise expressly stated in the individual listing.


Firearms offered at auction may be new, used, antique, collectible, modified, restored, refinished, or otherwise previously owned.


Descriptions and photographs are provided for informational purposes. Buyers are responsible for carefully reviewing the listing and asking questions before bidding.


O'Connor Auction Group does not guarantee the mechanical condition, safety, accuracy, bore condition, originality, or suitability of any firearm unless expressly stated in writing.


Buyers should have firearms inspected by a qualified gunsmith before use when appropriate.


A firearm should never be fired solely because it appears functional or because an auction listing describes it as functional.

 

10. Firearm Identification and Listing Information


Individual listings may include manufacturer, model, caliber or gauge, serial number or other identifying information, photographs, condition information, accessories, and other relevant details.


Buyers are responsible for reviewing the complete listing before bidding.


If a Buyer believes information in a listing is incomplete or inaccurate, the Buyer should contact O'Connor Auction Group before placing a bid.

12. Ammunition and Other Regulated Items


Ammunition and other regulated products may be subject to additional federal, state, local, carrier, and platform restrictions.

 

Additional restrictions may be stated in the individual lot description.


13. Platform Rules


Firearms may be advertised or offered through third-party auction and marketplace platforms, including AuctionZip, GoToAuctions, Proxibid, HiBid, GunBroker, or other platforms.


Each platform may impose additional rules concerning firearms, ammunition, firearm accessories, prohibited items, advertising, bidding, shipping, and transfers.


Where a platform imposes additional requirements, the Buyer and O'Connor Auction Group must comply with those requirements in addition to these Terms.


14. Bidding and Winning a Firearm


A winning bid constitutes a binding purchase commitment subject to the Buyer's legal eligibility to receive the firearm.


The fact that a Buyer successfully places a bid or wins an auction does not guarantee that the Buyer will be approved to receive the firearm.


A Buyer should not bid on a firearm unless the Buyer is prepared to complete the applicable legal transfer requirements.


15. Payment


Payment must be made in accordance with the payment terms stated for the applicable auction.

 

Payment for a firearm does not authorize release of the firearm before all required transfer procedures have been completed.
O'Connor Auction Group may require payment in full before beginning the transfer or shipping process.


16. Buyer's Premium, Taxes, and Fees


The applicable buyer's premium, sales tax, shipping charges, transfer charges, and other fees will be stated in the applicable auction terms or lot description.

 

The Buyer is responsible for all charges properly applicable to the transaction.

 

17. Consignment Firearms


Where a firearm is offered on consignment, O'Connor Auction Group will handle the firearm in accordance with applicable FFL recordkeeping and transfer requirements.


The consignor's ownership of the firearm does not eliminate or modify the legal transfer requirements applicable to the eventual purchaser.


18. Compliance and Refusal of Transfer


O'Connor Auction Group reserves the right to refuse or delay a firearm transfer when necessary to comply with federal, state, or local law; ATF requirements; applicable court orders; platform requirements; carrier requirements; or our reasonable compliance procedures.


If there is uncertainty regarding the legality of a proposed transfer, O'Connor Auction Group may require additional documentation, consultation with the appropriate FFL or government agency, or legal review before proceeding.


19. Buyer Responsibility


By bidding, the Buyer acknowledges that the Buyer has had an opportunity to review the applicable auction terms and firearm listing and agrees to comply with all applicable transfer requirements.


The Buyer is responsible for knowing the laws applicable to the Buyer's residence and intended possession or use of the firearm.


20. Questions Before Bidding


Questions concerning a firearm's condition, specifications, photographs, accessories, transfer requirements, or other material information should be directed to O'Connor Auction Group before bidding.


Once a bid has been placed, the Buyer is responsible for the bid in accordance with the applicable auction terms.


21. Changes to These Terms


O'Connor Auction Group may update these Terms when necessary to reflect changes in applicable law, regulations, ATF requirements, platform requirements, or company procedures.


The version applicable to a particular auction will be identified in the auction materials.
